Article 1. Acceptance and Interpretation
1.1 Welcome to the MMIC Platform. These Terms constitute a binding agreement between you (the “User,” including an individual, enterprise, or organization) and the operator of MMIC concerning all services offered by the Platform, including mining data, news and information, memberships, tenders, GIS, and consulting.
1.2 By registering an account, logging in, purchasing a paid membership, browsing or downloading Platform data, or submitting a consulting request, you acknowledge that the Platform has adequately drawn your attention to and explained provisions that limit or exclude the Platform's liability or restrict User rights. You are deemed to have read, understood, and agreed to all of these Terms and to be bound by the MMIC Privacy Policy. If you do not accept these Terms, do not register, pay for, or use any Platform service.
1.3 Important Notice: These Terms contain prominently stated binding provisions concerning non-refundable paid memberships, restrictions on intellectual property rights in data, disclaimers for cross-border mining information, and restrictions on account ownership and use. Please read them carefully.
1.4 Definitions
MMIC Platform: the Chinese-language mining data website at www.mmic.com.cn, which provides services including Mongolian mining news, commodity transaction data, border-port market information, GIS mining-right maps, mining tenders, industry reports, one-to-one mining consulting, and project investment information.
Membership Services: a tiered paid subscription system that unlocks value-added access to complete datasets, bulk downloads, exclusive reports, bilingual information including Chinese, tender alerts, complete GIS layers, and other features.
Platform Data: data and information concerning production of copper, coal, gold, iron ore, and other minerals in Mongolia; transaction prices; corporate trading announcements; mining licenses; policies and regulations; project feasibility studies; import and export border-port data; and industry news flashes.
User Content: consulting forms, procurement requests, enterprise information, messages, and other content uploaded, published, or submitted by a User. The User warrants that it holds lawful and complete intellectual property rights in User Content, free of any defect in title, and grants the Platform a perpetual, royalty-free, non-exclusive, sublicensable right to use such User Content lawfully for operational purposes. The User bears all liability if User Content infringes a third party's lawful rights and shall fully compensate the Platform for all resulting losses.
Paid Services: membership subscriptions, custom industry reports, specialized mining consulting, customized mining-right GIS data, and tender agency services.
Article 2. Platform Services
2.1 Free Basic Services
The following services may be used without a paid registration:
- basic previews of publicly available Mongolian mining news flashes and industry briefs;
- simplified display of basic mining-company logos and names and public tender titles;
- simplified viewing of basic Mongolian mining-map layers;
- browsing excerpts of policies and regulations made publicly available on the Platform; and
- basic online customer-service consultation.
2.2 Services Exclusive to Paid Members
The following services are unlocked after purchasing a membership subscription:
- Complete mineral transaction data: full transaction details, tonnage, floor prices, transaction times, and multi-currency quotations for coal, copper concentrate, iron ore, and gold transactions conducted by Erdenes, ETT, Mongolian Mining, and other enterprises;
- Complete in-depth industry reports: monthly and quarterly analyses of Mongolia's coal, copper, and precious-metals markets and analyses of the finances, capacity, imports, and exports of major projects such as Oyu Tolgoi and Tavan Tolgoi;
- Full GIS resources: complete mining-license layers, road, railway, and border-port infrastructure maps, mineral-resource locations, visual searches of mining-company distribution, and layer exports;
- Complete tender resources: full documents, budgets, application requirements, and bilingual file downloads for all Mongolian mining exploration and exploitation-license tenders;
- Real-time alerts: email or in-platform alerts for daily mining news, unusual movements in copper, coal, and precious-metals prices, and changes in Mongolian mining policy;
- Complete trilingual documents: full access to and downloads of mining laws, contracts, and project documents in Mongolian, English, and Chinese;
- Dedicated one-to-one consulting: professional consulting on Mongolian mining policy, cross-border trade, investment in mining rights, logistics, and border ports; and
- bulk data exports, historical data access, and searches of full-lifecycle enterprise operating data.
2.3 Customized Value-Added Paid Services
Services charged separately from membership subscriptions include custom research reports, coordination of on-site mine research in Mongolia, organization of mining-right compliance and legal materials, commodity-trade quotation calculations, and preliminary reviews of mining-project investment feasibility.
Article 3. User Registration and Account Management
3.1 Registration Requirements
- Individual Users must provide a genuine mobile-phone number and email address. Enterprise Users must additionally provide the enterprise name, Unified Social Credit Code, and contact-person information. The Platform may verify the identity and authenticity of the registrant.
- Users warrant that registration information is true and valid and shall update it within three days after any change. Users bear all losses arising from a failure to receive information, invoices, or notices because their information is false or invalid.
- Each person or entity may register only one primary account. Bulk registration of secondary accounts and automated registration are prohibited.
3.2 Account Security Obligations
- Users are solely responsible for safeguarding their accounts, passwords, and verification codes. All browsing, downloading, payment, and data-export activity under an account is deemed to have been performed by the User.
- Users bear all liability for data leakage, unauthorized downloading, and infringement arising from a leaked or stolen account or from allowing another person to use an account. Users shall fully compensate the Platform for all resulting losses. A User who discovers abnormal login activity must immediately contact Platform customer service to freeze the account. If failure to give timely notice increases a loss, the User bears full liability for the increased portion.
- Transferring, renting, selling, or sharing a membership account, including shared use of an enterprise account by multiple persons or account resale, is strictly prohibited. If the Platform detects bulk logins from multiple geographically dispersed IP addresses or distribution of an account for third-party use, it may immediately freeze the account, cancel all membership benefits, and deny any refund.
3.3 Account Deletion
A User may request account deletion. Upon deletion, unexpired membership benefits terminate immediately; downloaded data may be used only internally and may not be disseminated externally; the Platform will retain transaction and invoicing records as required for financial and tax compliance and delete other personal information in accordance with the Privacy Policy.
Article 4. Membership Subscriptions, Charges, and Refunds
4.1 Published Charges
Prices for all membership plans, custom reports, and consulting services are published on the applicable pages. The Platform may adjust prices based on market conditions and will publish an in-platform notice seven days before an adjustment. A current price adjustment does not affect a paid membership that has not yet expired.
4.2 Payment and Invoices
The Platform supports enterprise bank transfers and third-party online payments. After payment, a User may request an ordinary value-added tax invoice. The User is responsible for entering the invoicing information, and an invoice will not be reissued once issued.
4.3 Membership Term
A membership takes effect immediately upon successful payment and remains valid for the term of the purchased plan (monthly, quarterly, or annual). All value-added access automatically ends upon expiration. Users may renew to continue their benefits.
4.4 Refund Policy (Core Provision)
- You acknowledge that the Platform separately drew your attention to the refund policy before payment and that, once a paid membership is activated, no refund will be provided in the absence of a quality defect. A proportional refund may be requested only if a systemic Platform failure continues for more than 72 consecutive hours and makes all membership data, information, and GIS functions completely inaccessible, as verified by the technical team. The remaining membership fee will then be refunded in proportion to the number of unusable days.
- No refund is available for reasons attributable to the User, including an accidental purchase, a decision not to use the service, forgetting to renew, internal enterprise adjustments, inability to understand the data, or data that does not meet the User's expectations.
- If the Platform bans an account because the User breached these Terms by improperly sharing the account, scraping data, or infringing rights through distribution of Platform materials, the remaining membership fee will not be refunded.
- No refund is available after delivery of a one-time value-added service, such as a custom report, one-to-one consultation, or single tender download, regardless of whether the User is satisfied.
Article 5. User Conduct (Prohibited Conduct)
5.1 Commitment to Lawful Use
Users may use Platform data, reports, and GIS materials only for their own organization's internal operations, investment reference, and industry research.
5.2 Strictly Prohibited Conduct
Upon discovering any of the following conduct, the Platform may immediately freeze or delete the account, terminate service, and refuse to refund any unused service fee. If the User's conduct causes loss to the Platform, the Platform may pursue the User's full legal liability and require compensation for all losses:
- reselling or distributing any Platform data, reports, GIS maps, written information, or translated documents; making them publicly available free of charge; uploading them to a third-party website; or sharing them in online groups;
- using crawlers, scripts, plug-ins, or bulk tools to scrape or download Platform databases, transaction details, or mining-right layers in bulk;
- splitting, compiling, or adapting Platform data to create derivative materials for external commercial use;
- cracking Platform access controls, circumventing payment mechanisms, tampering with page data, or attacking Platform servers;
- sharing, renting, or selling membership accounts or distributing data in bulk to third parties in the same industry or to competitors;
- using Platform data for illegal cross-border mineral trade, fraudulent mining-right investments, or fraudulent business activities;
- publishing or disseminating content that violates the laws, regulations, or mining regulatory policies of China or Mongolia or that concerns prohibited political or ethnic matters or contains false information or rumors. The Platform may immediately remove the offending content. The User bears all resulting liability and shall fully compensate the Platform for all losses;
- forging enterprise qualifications, submitting false procurement requests, or maliciously occupying Platform consulting or tender-matching resources. The User shall pay the service price corresponding to the resources actually occupied and fully compensate the Platform for any other losses; or
- reverse engineering or disassembling the Platform website, system source code, or underlying GIS-layer files.
5.3 Data-Use Risk Notice
The Platform's Mongolian mineral data is sourced from official Mongolian publications, public trading announcements by mining enterprises, and industry research. The Platform has performed reasonable verification of the sources, and the data is provided only for business reference. The Platform is not liable for a User's investment or trading losses arising from timeliness deviations or content differences caused by changes in Mongolian policy, temporary quotation adjustments by mining enterprises, border-port logistics changes, geopolitical market fluctuations, or other circumstances not resulting from the Platform's intentional misconduct or gross negligence. Users must conduct their own due diligence and verify original local official materials before making mineral-trading or mining-right investment decisions.
Article 6. Intellectual Property
6.1 Ownership of All MMIC Platform Content
All intellectual property rights in Platform content, including copyright, compilation rights in data, trademark rights, and other intellectual property rights in written information, market-analysis reports, GIS map layers, data tables, bilingual translated documents, page logos, MMIC marks, industry charts, and compiled mining-enterprise files, belong to the MMIC operator and are protected by the Copyright Law, the Trademark Law, and applicable intellectual property laws of China and Mongolia.
6.2 Limited License to Users
A paid member receives only a non-exclusive right of use for the individual's or enterprise's internal purposes. No right is granted to copy and distribute, resell commercially, make content publicly available online, or retransmit it. Without the Platform's written permission bearing its official seal, Platform data and reports may not be externally published, used in public-facing promotions, or incorporated into a third party's paid product.
6.3 Liability for Infringement
If a User breaches the intellectual property provisions, the Platform may permanently ban the account, cancel all membership benefits, and require the User to pay liquidated damages equal to three times the service fees paid for the current term. If the liquidated damages are insufficient to cover the Platform's losses, the User shall pay the shortfall. If the breach causes Platform data leakage, customer loss, or commercial loss, the operator may bring a civil action and seek compensation for all economic losses and enforcement costs, including attorneys' fees, notarization fees, and travel expenses.
Article 7. Platform Rights and Limitations of Liability
7.1 Platform Operation and Maintenance Rights
The Platform may optimize website functions, update data, adjust membership benefits, or discontinue outdated sections at any time. Services may be temporarily suspended for server maintenance or system upgrades. Scheduled maintenance will be announced in advance through the Platform, and no compensation is available for brief downtime.
7.2 Third-Party Content Disclaimer
Mongolian mining-enterprise logos, corporate trading announcements, public tender documents, and external industry news displayed on the Platform are materials independently published by third parties. The Platform merely organizes and displays the information and does not warrant the truthfulness or legality of third-party materials. Users and Mongolian mining enterprises shall resolve their own trade or investment disputes; the Platform provides no intermediary guarantee and bears no performance liability. If a third party asserts a claim against the Platform because a User used Platform content to engage in misconduct, the User shall fully cover all resulting Platform losses, including compensation, enforcement costs, notarization fees, and attorneys' fees.
7.3 Force Majeure
The Platform is not liable for compensation when delayed data updates or service interruptions result from circumstances beyond its control, including natural disasters, cross-border network failures, temporary changes in Mongolian policy, customs controls, international geopolitical conflict, hacking, or telecommunications-network outages.
7.4 Liability Cap
Under all circumstances, the Platform's total liability to a User for all losses shall not exceed the total membership or service fees paid by the User to the Platform for the current term.
Article 8. User Information and Privacy Protection
Personal and enterprise information generated through User registration and payment is collected, stored, and used in accordance with the MMIC Privacy Policy. The Platform will keep Users' business materials strictly confidential and will not disclose private information to unrelated third parties without the User's written consent. Please refer to the separate Privacy Policy for details.
Article 9. Amendments and Delivery of Notices
9.1 Amendments
The Platform may amend these Terms in response to changes in laws, regulations, or its business. The amended version will be announced on the website homepage, and notice will also be sent through in-platform messages, the registered email address, and the mobile-phone number linked to the account. The updated version will be posted for seven days. If the User does not delete the account within seven days and continues using Platform services, the User is deemed to have accepted the amended Terms.
9.2 Notice Channels
Platform notices are delivered through in-platform messages, the registered email address, and the mobile-phone number linked to the account. A notice is deemed validly delivered even if the User cannot receive it because the contact information provided by the User has become invalid.
Article 10. Dispute Resolution
10.1 The formation, performance, and interpretation of these Terms are governed by the laws of the People's Republic of China.
10.2 A dispute between a User and the Platform shall first be addressed through online customer-service consultation. If no agreement can be reached, the dispute shall be submitted to the People's Court at the place where the Platform operator is located.
Article 11. Miscellaneous
11.1 If any provision of these Terms is invalid, the legal validity of the remaining provisions is unaffected.
11.2 These Terms and the MMIC Privacy Policy together constitute the entire service agreement.
